IMCW EUROPE S.L. (hereinafter, “IMC Europe”), domiciled at Paseo de la Farola 8, entreplanta, oficina 5, Malaga 29016 Spain, and registered in the Commercial Registry of Malaga, with CIF B65909863, is the manager of the web www.fashionomicsafrica.org (hereinafter, “the SITE”) on behalf of the African Development Bank, puts at the disposal of Internet users for the purpose of regulating the provision of personal information in the execution of the different services through the SITE in the following Terms. If you do not agree with all the Terms, or if you are under the age of thirteen (13), do not use the Site. Please, review all of the Terms carefully before using the Site.
The Terms of Use of the SITE, along with the general terms and conditions governing the provision of services, and/or conditions that may be established, have the purpose of regulating the provision of personal information and, where appropriate, the contractual relations that arise or may arise between Users and IMC Europe. By browsing the SITE and/or by using the services here included, you acquire the status of User. Both the navigation, and/or use of any of the services of the SITE, supposes the agreement and acknowledgment of the acceptance without reservations of any kind, to any and all of these Terms of Use, and the General Contracting Conditions that govern the provision of the services offered on the SITE, as well as the Specific Conditions, if any, that may exist in relation to the provision of services. IMC Europe reserves the right, at its sole discretion, to change, modify, or remove at any time and without notice, portions of these Terms and Conditions and/or the special conditions, if any, here included, by posting such changes on the SITE in order to make them known by Users before they visit the SITE. These Terms of Use will apply to any promotional activity and provision of information that is carried through the SITE as well as, where appropriate, to the provision of the services offered on the SITE, so that the same shall apply at all times both when browsing the SITE, to the provision of services under the SITE, although these latter activities additionally will be subject to both these Terms of Use, and to the applicable General Contracting Conditions, and to any particular conditions which could exist.
All contents displayed on the SITE including but not limited to, designs, text, graphics, logos, icons, buttons, software, trade names, trademarks, industrial designs or any other signs susceptible to industrial and commercial use are subject to their owners’ intellectual property rights. IMC Europe will use the content as provided by the users. The SITE has been prepared by IMC Europe for the African Development Bank. The website does not necessarily reflect the views of the Bank. Information provided by the Bank and third other parties may have been used in the preparation of the website, but was not independently verified by IMC Europe. The information of the SITE is provided for informational purposes only and shall not be relied upon by third parties as a specific professional advice or recommendation. Neither IMC Europe nor its affiliates or related entities, or the Bank shall be responsible for any loss whatsoever sustained by any party who relies on any information included in this document. Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without IMC Europe’s express prior written consent.
Except typographical error, IMC Europe is solely responsible for the promotions and offers contained in the SITE. IMC Europe is not liable for any other promotion or offer other than those contained in the SITE. IMC Europe is only liable for damages that the User may suffer as a result of the use of the SITE when such damage is attributable to willful misconduct of IMC Europe. The User acknowledges and agrees that the use of the SITE, as well as, where appropriate, the provision of services offered therein is at his sole risk and responsibility. IMC Europe is not responsible for any damages that may arise from (i) inferences, omissions, interruptions, computer viruses, faults and/or disconnections in the operational functioning of this electronic system or appliances and computer equipment that prevent users from or delay the provision of services or navigating the system, (ii) delays or blockages in the use caused by deficiencies or overloading of the Internet or other electronic systems, (iii) those caused by third parties through illegal interference beyond the control of IMC Europe, (iv) the inability to provide the Service or allow access for reasons not attributable to IMC Europe, due to the User, third parties or events of force majeure. IMC Europe does not promise that the site or any content, service or feature of the site will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the site will provide specific results. All information provided on the SITE is subject to change without notice. The User acknowledges and voluntarily accepts that the use of the services takes place, in any case, under his sole responsibility. IMC Europe does not guarantee the accuracy, completeness or usefulness of any message, so that in no event shall be responsible for any content or consequences of the use of this information.
You must follow the policies available through the Services. You must not use our Services improperly. You can only use the Services to the extent that the law allows. We may suspend or cancel our services if you do not meet our policies or conditions, or if we believe that your conduct may be malicious. IMC Europe may disclose any information we have about you if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the SITE, or to identify, contact or bring legal action against someone who may be causing injury either intentionally or unintentionally to IMC Europe’s rights or property, or the rights or property of users of the SITE. In general, the User agrees to comply with these Terms of Use, particular conditions that may apply, as well as to meet the special warnings or instructions contained therein and always act according to the law, morality and the requirements of good faith, using the appropriate diligence to the nature of the service enjoyed by refraining from using the SITE in any way that may impede, damage or impair the normal functioning of the SITE, the property or rights of IMC Europe, other users or any third overall. Specifically, and without implying any restriction on the obligation assumed by the User generally in accordance with the preceding paragraph, the User agrees to the use of the SITE to: (i) Not enter, store or transmit on or from the SITE, any information or material that is defamatory, libelous, obscene, threatening, racist, incites violence or discrimination based on race, sex, creed, religion or any manner prejudicial to morality, public order, fundamental rights, public freedoms, honor, privacy or image of others and in general the current regulations, (ii) Not enter, store or transmit through the site any program computer, data, viruses, code, hardware or telecommunications or other instrument or electronic or physical device that is capable of causing damage to the SITE, in any of the Services, or any of the equipment, systems or networks of IMC Europe, of any User of IMC Europe, providers or in general any third party, or otherwise be able to cause any kind of damage or impede the normal operation thereof, (iii) Not to make advertising, promotional or commercial exploitation through the SITE, not using the contents and in particular the information obtained through the SITE to send advertising messages for direct marketing purposes or any other purpose, or to collect or store personal data third party, (iv) Not enter, store or transmit through the site any content that violates intellectual property rights, industrial or business secrets of others, or in general any content that does not hold, in accordance with the law, the right to make it available to third parties.
The provision of the services of the SITE and these Terms of Use are subject to the Spanish law. Each Party shall comply with the law and applicable legal standards. The Parties agree to be subject to the Courts and Tribunals of Spain, in relation to any actions and claims that may arise from the interpretation, validity and performance of the SITE.

Through Fashionomics Africa (FA), we put sellers and buyers in contact although we are not responsible for any problem with the packaging and shipping of the goods or billing issues.
After creating a seller account in the FA’s platform, the seller needs to register with DHL Express for an ExpressEasy Card. This is a unique identifier that will enable the seller to access preferential rate. These are the contacts to get your Card:

The seller, after receiving a purchase order, agrees to prepare the order and go to the nearest DHL service point as soon as possible (see table below). DHL Express to lend assistance in packaging the consignment and preparing the DHL waybill and commercial invoice for export purposes.
From the moment that the seller receives a purchase order from a customer, the FA team is no longer responsible for any problems that may arise.
FA does not guarantee the money refund to the buyer, being this the responsibility of the seller.

Purpose and Legal Basis for Processing
The SITE collects and processes personal data including, but not limited to, personal identification information including name, email address, phone numbers etc. IMC Europe collect this data so that we:
- can allow the User access to our services;
- keep the User informed about services or products that may be of interest to you, including those provided by a third party, and to provide technical and commercial information about the SITE;

Retention Periods
If the legal basis for retaining your data is Legitimate Business Interest, IMC Europe will retain the User’s personal data for managing our clients and subscribers in accordance with IMC’s Data Retention Policy. If the legal basis for holding the User’s data is Contractual Necessity, IMC Europe will retain your personal data as required to fulfil our contractual obligations and to comply with our legal obligations, resolve disputes and enforce our agreements.
Where IMC Europe no longer need to process your personal data for the purposes set out above, IMC Europe will delete your personal data from our systems.
Using cookies and activity files IMC Europe or a third party contracted to provide measurement services may use cookies when the Users browse the SITE. Cookies are files sent to the browser by a web server in order to record the User´s activities during its navigation.
Cookies used by the SITE are only associated with an anonymous user and computer, and themselves do not provide personal data of the User. By using cookies, it is possible to the SITE´s server to recognise the web browser used by the User in order to make navigation easier, allowing, for example, access to Users who have registered previously, access areas, services, promotions or competitions reserved exclusively for them without having to register each time. They are also used to measure the audience and traffic parameters, monitor the progress and number of entries.

Your Rights
The User has the right to:
- access any personal data IMC Europe holds about you. IMC Europe will provide details of the purposes of the processing, the types of personal data we hold and the people to whom your personal data has been disclosed;
- data Portability – Subject to certain conditions, the User is entitled to receive the personal data which you have provided to IMC Europe and which is processed by IMC Europe by automated means, in a structured, commonly-used machine readable format.
- have inaccurate or incomplete personal data corrected or to restrict the processing of personal data whilst the accuracy is checked;
- where data is held for legitimate business interest the User has the right to ask to have personal data IMC Europe holds about you erased. This enables the User to ask IMC Europe to delete or remove personal data where there is no good reason for IMC Europe continuing to process it. The User also has the right to ask IMC Europe to delete or remove your personal data where the User has successfully exercised your right to object to processing, where IMC Europe may have processed your information unlawfully or where IMC Europe are required to erase your personal data to comply with local law;
- withdraw consent at any time where IMC Europe are relying on consent to process the User’s personal data. However, this will not affect the lawfulness of any processing carried out before the User withdraws your consent; and
- lodge a complaint with the Ley Española de Protección de Datos – AEPD if you have a concern about your personal data.

The User can unsubscribe from any of the subscription services provided by clicking the unsubscribe section of all emails sent by IMC Europe.
IMC Europe may need to request specific information from the User to help us confirm the User’s identity and ensure the User’s right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who does not have the right to receive it. IMC Europe may also contact the User to ask you for further information in relation to your request to speed up our response.
There is no charge for you to access your data, however, IMC Europe reserve the right to charge a fee for reasonable administration costs where the request is excessive or to provide further copies of your data.
We aim to respond to all legitimate requests within one month.
